This is an Endowment Care Cemetery

All public cemeteries are required to charge an endowment fee, to provide the funds for long term maintenance.

San Miguel District Cemetery

Rules & Regulations

The front gates will be open  between the hours of 8:00 AM and 5:00 PM. A gate to  the side of the front entrance is open to pedestrians at all times.

Lots in the Cemetery are conveyed for burial purposes only. Burial of time capsules can be in a memorial garden, with the Board of Trustees’ permission.

 

No Burials will be permitted in the Cemetery without an Application and Permit for Disposition of Human Remains from the proper authorities. The District Secretary of the Cemetery will receive said application, sign and mail it to the Registrar of District of Death.

  •  A minimum of two (2) workdays must be given to the to the Cemetery before the opening and closing of any grave.

  • The District operates on a cash in advance basis on all costs and fees required for interment.

  • A licensed and insured contractor, approved by the S.M.D.C. Board of Trustees, will perform the opening and closing grave sites; the S.M.D.C. groundskeeper will perform interment of ashes.

  • Grave liners must be purchased from a licensed and insured contractor, approved by the S.M.D.C. Board of Trustees, and installed by said contractor and must be used with all casketed remains.

  • Human remains shall not be received for interment unless enclosed in a suitable receptacle of wood or other material acceptable to S.M.D.C. Board of Trustees, to the end that it will withstand normal handling and the health of employees or other will not be jeopardized. Cement, metal, wood, plastic, or fiberglass urns must be used for cremated remains.

Opening and closing of graves within the perimeters of an existing coping or curb, or covered by a concrete slab or cap, shall be done at additional cost above the normal opening and closing fee set by the trustees. Additional fees shall recover all additional cost incurred.

Monday through Saturday services shall be allowed between the hours of 9:00 a.m. and 1:00 p.m.. Only interment of ashes or private memorial services will be allowed on Saturday afternoon. No graves shall be opened, burials made or private memorial services held on Sundays or legal holidays.

Pre-need lot sales to individuals or families shall be held to ten (10) plots.

​

All markers used in the Cemetery's lawn areas must be of a permanent material and set flush with the grade level of said plot, and must be accepted by the S.M.D.C. Board of Trustees as being of conformity with the Rules and Regulations of the Cemetery before being installed. On regular graves, no single marker may exceed 12 x 24 inches and have a smooth cut. No double marker may exceed 12 x 36 inches.

Flowers may be placed on graves in suitable vases installed level with the turf. Only two (2) vases are permitted per grave. FLOWERS WILL BE REMOVED PRIOR TO MOWING EACH WEEK ON THURSDAYS OR FRIDAYS on the lawn areas. The District shall not be liable for floral pieces, baskets, frames, and vases. At no time will glass vases, bottles, or jars be allowed. No person other than Cemetery personnel may plant trees, shrubs, flowers, or plants within the Cemetery.

Liability: The District, its Board of Trustees and all individual members of said Board and all other personnel employed by the District shall not be responsible for injury or damage suffered by any person, including children, in the use of the Cemetery grounds or its facilities. Any person using the roadways, streets, paths, or facilities in the Cemetery shall do so at their own risk.

​

Interment of more than one casketed body in one grave shall not be allowed.

​

Interment of more than four cremated remains in one grave will not be allowed.

​

At the time of casketed remains are lowered, the family will be required to move thirty (30) feet from the grave at the direction of Cemetery personnel. They will not be allowed to participate in the lowering of the remains or placement of dirt, other than with the interment of ashes.

​

Only Cemetery personnel or paid contractors will be permitted to set liners, caskets in said liners, markers or any similar work on the grounds of the Cemetery.

​

Burial of infants in occupied graves of friends or relatives: 

  • This practice will only be allowed if the existing burials are at a sufficient dept to allow for proper burial of infant remains.

  • The regular fees and charges will be made for an infant opening and closing.

​

AT NO TIME SHALL THE OPENING OF A CASKET BE PERMITTED ON THE CEMETERY GROUNDS unless done by a mortuary conducting the graveside service.

​

At the time of disinterment, the Cemetery personnel or their paid contractor shall:

  • Remove dirt from the grave, raise the lid from the concrete unit and remove the casket. In the event that the casket has deteriorated, the removal of the remains shall be supervised by a licensed Funeral Director.

  • It is further ordered that said casket and/or remains shall be placed in a container, such as wood, before being transported to another portion of the Cemetery.

  • That remains disinterred in another Cemetery and to be re-interred in the District Cemetery shall be encased in a container, such as wood, before delivery to the district Cemetery.

  • THE SAN MIGUEL DISTRICT CEMETERY WILL NOT BE HELD LIABLE FOR ANY DAMAGE TO THE CASKET OR REMAINS BEING DISINTERRED.

The drinking of alcoholic beverages on the grounds of San Miguel District Cemetery is strictly prohibited.

​

Resident fees will be granted to persons residing within the San Miguel District Cemetery boundaries. Non-resident fees will be assessed to any persons not residing within the San Miguel District Cemetery boundaries. (EXCEPTION: If a resident is forced to move out of the district boundaries due to illness or to a nursing home, they may be granted resident fees).

The board of Trustees of the San Miguel District Cemetery reserves the right to add or make such changes in the Rules and Regulations as are necessary.
